and implementation of emergency plans. This exception is being invoked to

RE: Surf Fishing Tournament
DATE: August 29, 2018
ISSUE(S): Scott Wallace for the Ocean City Surf Anglers Club requests
Council approve their annual surf fishing tournament, tentatively
scheduled to be held Friday and Saturday, October 5 and 6, 2018
on the beach between 30th and 119th Streets, 7 am until 4 pm
daily.
SUMMARY: Historically, up to 90 six (6) person teams compete in this surf
fishing tournament, in which each team has no more than three
(3) vehicles on the beach at any time.
The applicant has requested “rotating surf fishing” for
participating teams, with rotations daily. Ocean City Beach
Patrol (OCBP) is concerned with the potential for a large amount
of vehicular traffic on the beach, and strongly requests the event
participants’ vehicular movement be restricted to within five (5)
block (north or south) crossovers, if traversing the beach.
OCBP requests the applicant advise all participants that OCBP will
be patrolling the beach and may need to go near the event set -
up if an emergency arises. Also, OCBP wants the applicant to be
aware that there may be people not affiliated with the event on
the beach and in the water during the event times and to please
share the beach. Lastly, if there is lightning, the event may
remain on the beach, but only inside their vehicles, and may not
return to fishing until 30-minutes following the last visible
lightning flash.
FISCAL IMPACT: In previous years, the applicant has requested, and been granted
by Council, to pay the city space fee of $250 per day, but not per
ocean block. If this request is again approved, the applicant shall
pay $600 in private event fees.
RECOMMENDATION: Approve the event as presented.

RE: 9/11 Parade of Brothers

ISSUE(S): The Red Knights Motorcycle Club Maryland Chapter 3 (Red
Knights) has a three (3) year event date hold for their event, the
Parade of Brothers, which has been approved by Council up to
2019. John Tartufo, on behalf of the Red Knights, requests
Council continue this provision, and approve an event date hold
for September 11, 2020.
SUMMARY: Please note: While the actual application request is for the use
of 27th Street, due to the new security measures on the
Boardwalk, the event will need to move south one (1) block to
26th Street.
This event is a motorcycle parade, which begins at 11:30 am on
the Boardwalk at 26th Street and continues south to North
Division Street, with a 9/11/01 memorial service at the Firemen’s
Memorial beginning at 12 noon.
The applicant requests use of 26 th Street and the Boardwalk for
registration, setting up a table and 10’x10’ pop -up tent (if
needed). Also requested is use of the north side of North
Division Street between the Boardwalk and Baltimore Avenue for
motorcycle parking during the memorial service, police
assistance with the parade and as an escort out of town on Route
50 after the service, as well as use of the Town’s PA system and
podium during the memorial service.
FISCAL IMPACT: THe applicant shall pay $87.50 in private event fees and $195.60
in asset and support fees, for a total of $283.10.
RECOMMENDATION: Approve the event as presented.

SUMMARY: On November 2-3, 2018, the Maryland National Guard, along
with several other state and federal agencies, will be conducting
a complex series of exercises and live demonstrations in Ocean
City. This state exercise was mandated through the Governor’s
office to test and highlight the interoperability and effectiveness
of multi-organizational emergency response management.
The unique training opportunity will be open to the public in
downtown Ocean City at the Inlet Parking Lot. The viewing public
will be able to watch responders in action and learn about the
importance of various agencies.

ISSUE(S): Second reading of Ordinance 2018-11
SUMMARY: On July 3, a helicopter landed at the church on 17th Street and
discharged passengers. While this is a highly unusual event, it
appears not to have violated any laws. The helicopter is owned
by a charter company from Westminster. We presume the pilot
had the property owner’s permission to land at the church site. If
so, and if this is a sporadic occurrence, the Federal Aviation
Administration (FAA) would consider the landing site
“intermediate.” This is allowed under FAA regulations.
An initial discussion occurred at the July 10 Work Session. Mayor
and Council instructed emergency management, the zoning
administrator and airport manager to research and recommend
regulations for consideration. A draft ordinance was presented at
the July 31 and August 14 Work Sessions. Ordinance
amendments include the following:
1) Municipal infraction fine of up to $1,000 (for each landing and
launching);
2) Pilot will be the subject of a formal complaint to the FAA;
3) The launching of aircraft has been added.

subject to a fine ofup to $1,000.00, with each launching;
and
iii.be the subject of a formal Complaint to the Baltimore Flight
Standards District Office of the Federal Aviation
Administration.

SUMMARY: Steve Carullo and Jay Bosley of de Lazy Lizard are requesting
permission to close a portion of First Street between the bay and
Bayview Lane, consisting of 19 paid parking spaces, from
Thursday, September 13 at 2:00 p.m. through Sunday,
September 16 at 2:00 p.m. for motorcycle parking in designated
parking spaces.
An insurance certificate will be provided and road area north of
the double yellow lines will remain open and available for
emergency vehicles to access.
Time did not allow for this request to be scheduled for Police
Commission consideration first. There are no changes from
previous year approvals.
FISCAL IMPACT: $1,938.00
Paid parking effective 7:00 a.m. - Midnight. Nineteen (19) paid
parking spaces @ $2.00/hour for the following hours:
Thursday - 10 hours = $380

TRAFFIC COMMISSION REGULATION 2018 – 03
Pursuant to the power and authority vested in the Commission by Section 90-52 and 90-53 of Chapter
90 of the Code of the Town of Ocean City, the following regulation is hereby promulgated this 4th day of
September, 2018.
Permission has been granted for a street closure for the de Lazy Lizard on First Street, between the Bay
and Bayview Lane, beginning Thursday, September 13, 2018 at 2:00 p.m. through Sunday, September 16, 2018
at 2:00 p.m., for motorcycle parking in designated parking spaces. Road Closure for motorcycle traffic will be
monitored by private security personnel. The Northside of 1st Street must remain free and clear of all
obstructions, no parking will be permitted. Additionally, the fire hydrant on the south side of 1st Street must
remain clear of all obstructions.
Proper clearance from the corner shall be maintained and all traffic safety regulations shall be observed.
The streets shall be maintained in a clean and orderly condition at all times.
The permittee shall assume all risks related to or in connection with the permitted activity and shall be
solely responsible for damage or injury, or whatever kind or nature to person or property, directly or indirectly
arising out of or in connection with the permitted activity or the conduct of permittee's operation.
For the protection of the public and the Mayor and City Council, the permittee must provide insurance
coverage in the amount of one million dollars ($1,000,000) single limit. Said insurance shall name the Mayor
and City Council as additional insureds.

Sec. 90-51. Creation.
There is hereby established a traffic commission which shall be the same body as is the
Ocean City police commission, pursuant to section C-413 of the Charter of the Town of Ocean City.
(Code 1972, § 99-84)
Sec. 90-52. Powers.
The traffic commission shall have the power to:
Establish speed limit regulations and changes thereof as necessary from time to time.
Prescribe by regulation the use of specific streets by specific vehicles, or prohibit the
use of specific streets by specific vehicles or prohibit certain pedestrian activities on
said streets.
Establish by resolution the direction and flow of traffic.
Establish by regulation one-way streets.
Establish by regulation no parking zones, time limitations on parking in other zones,
parking meter zones, times and prices, and loading and unloading zones.
Establish and authorize by regulation as necessary any temporary deviation from the
commission's regulations.

Sec. 90-53. Procedure for establishment of traffic regulations.
The traffic commission shall exercise its powers only as specified in this section. Whenever
any member of the commission deems it necessary to regulate traffic in any manner prescribed in
section 90-52 hereof, he shall immediately notify and call a meeting of the other members of the
commission. The commission shall meet and by majority vote determine the necessary regulation.
Said regulation shall be made in writing in the regulation form prescribed in section 90-54 hereof.
The commission shall then cause an appropriate sign or signs to be erected and prominently
posted in the area affected by said regulation, which said sign or signs shall properly notify the
public of the regulation. The commission shall then cause a copy of said regulation to be furnished
the Police Department and the Mayor. The said regulation shall become effective upon the signs
being posted and the aforesaid copies being delivered. Each member of the City Council and the
City Solicitor shall be mailed a copy of said regulation. Regulations so established shall remain in
effect until the next regular meeting of the Mayor and City Council and thereafter if ratified by a
majority of the Council and agreed upon by the Mayor. In the event, however, that the Mayor and
City Council fails to so ratify any such regulation, said regulation becomes immediately null and void
and of no force and effect whatever. In the event that the Mayor and Council ratifies said regulation,
the Chief of Police shall cause a copy of said regulation to be signed by the Mayor and president of
the Council and attested by the Council's secretary, with the date of ratification affixed thereto.
Temporary regulations created by the commission shall include a termination date. Said temporary
regulations shall automatically become null and void after said termination date.
